These Terms & Conditions ("Terms") govern your access to and use of www.the-islands.com and any purchase made through it. The website is operated by The Islands, trading as THE ISLANDS (GSTIN: 07MXBPS1775G1ZZ), with its registered place of business at D-3, Punjabi Bagh East, New Delhi, West Delhi, Delhi – 110026, India ("THE ISLANDS", "we", "us", "our"). By using the website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order. If you are under 18, you may use the website only with the involvement and consent of a parent or legal guardian.

2. Your Account

An account is required to place an order. You are responsible for keeping your login details confidential and for all activity under your account. Please provide accurate and up-to-date information, and tell us immediately if you suspect unauthorised use of your account.

3. Our Marketplace

THE ISLANDS is a curated marketplace that lists products from independent and international brand partners. Products are packed and shipped by the respective brand. We coordinate orders, tracking, customer support, returns and refunds. Product-specific details such as delivery estimates, return windows and eligibility are shown on each product page.

4. Product Information and Pricing

  • We try to display products, descriptions, colours and prices accurately, but minor variations may occur and errors may happen.
  • All prices are in Indian Rupees (INR). Applicable taxes and shipping charges are shown at checkout before you pay.
  • We may change prices, products and availability at any time without notice. Changes do not affect orders already confirmed, except in the case of an obvious pricing or listing error.

5. Orders

Placing an order is an offer to purchase. An order is accepted only when it is confirmed and dispatched. We or the brand may refuse or cancel any order, for example if the product is unavailable, there is a pricing or listing error, the address is not serviceable, or the order appears fraudulent. If a paid order is cancelled by us, you will receive a full refund to the original payment method within 7–10 working days.

6. Payments

Online payments are processed securely through our payment partner, Razorpay. We do not store your full card details. Cash on Delivery may be available for eligible locations and will be shown at checkout. By making a payment, you confirm that you are authorised to use the payment method.

7. Shipping, Cancellation, Returns and Refunds

Shipping is governed by our Shipping Policy, and cancellations, returns and refunds by our Return, Refund & Cancellation Policy. Both form part of these Terms. Approved refunds are processed to the original payment method within 7–10 working days.

8. Games, Rewards and Promotions

Games, rewards, raffles, discount codes and other promotions offered on the website are subject to their specific rules and eligibility conditions. We may modify, suspend or withdraw any promotion at any time. Rewards have no cash value unless stated otherwise and may not be transferred or exchanged.

9. Acceptable Use

You agree not to misuse the website, including by attempting to gain unauthorised access, interfering with its operation, using automated tools to scrape or place orders, posting unlawful or offensive content, or using the website for any fraudulent purpose. We may suspend or terminate accounts that breach these Terms.

12. Limitation of Liability

To the maximum extent permitted by law, THE ISLANDS will not be liable for any indirect, incidental, special or consequential loss arising from your use of the website or any product purchased through it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019 or other applicable law.

13. Indemnity

You agree to indemnify THE ISLANDS against any claims, losses or expenses arising from your breach of these Terms or your misuse of the website.

14. Privacy

Your use of the website is also governed by our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the website after changes means you accept the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable consumer protection laws, any dispute arising out of or in connection with these Terms or your use of the website will be subject to the exclusive jurisdiction of the courts at New Delhi, India.
